Terms and Conditions:
1. These terms and conditions govern the Burger Wisconsin Loyalty App.
- (a) Your use of the Burger Wisconsin Loyalty App confirms your agreement to these terms and conditions as may be varied from time to time.
- (b) You must comply with these terms and conditions.
2. Definitions in these terms and conditions
- “Burger Wisconsin Loyalty App" means: The app issued by Burger Wisconsin by which discounts can be earned and redeemed.
- "Points” means: Points credited by Burger Wisconsin to your Burger Wisconsin Loyalty App account.
- "Privacy Policy" means: The Privacy Policy set out on the website: The Burger Wisconsin website at www.burgerwisconsin.co.nz.
3. Participation
- (a) To participate in the Burger Wisconsin Loyalty App program you must obtain a Burger Wisconsin Loyalty App from the Apple App Store or Google Play Store. Only individuals may participate in the Burger Wisconsin Loyalty App program. You may not transfer your Burger Wisconsin Loyalty App or credit to another individual.
- (b) You must register and activate your Burger Wisconsin Loyalty App online to be able to redeem points.
4. Personal information about you
- (a) Personal information about you may be collected and held on behalf of Burger Wisconsin in accordance with the Privacy Policy. Any information collected and held may be used from time to time to administer the Burger Wisconsin Loyalty App program; provide you with services, for marketing and promotional purposes and for other reasons set out in the Privacy Policy. Under the Privacy Act 1993, you have rights of access to, and correction of, any personal information held by us.
- (b) If you have provided us with an email address or a text number, you agree that we may send you emails or text messages for any of the purposes set out in clause 4 (a) above or the Privacy Policy.
5. Lost or stolen phone or device
- If you have a lost or stolen phone or device with the Burger Wisconsin Loyalty App installed, you must immediately deactivate your app by notifying us so that we can do so on your behalf. To replace the lost or stolen Burger Wisconsin Loyalty App Card you need to:
- (a) Obtain a new device to install the app onto
- (b) Contact us to obtain your previous account information.
- (c) We are not responsible for any loss to you arising in relation to a lost or stolen phone or device and accordingly we cannot guarantee that all Points earned prior to the date of loss or theft of the phone or device will be available for use on your replacement Burger Wisconsin Loyalty App.
6. Burger Wisconsin Loyalty App
- (a) To earn Points you must notify the participating store before the transaction is concluded that the transaction is a Burger Wisconsin Loyalty App transaction. This must be done by presenting your phone or device with the Burger Wisconsin Loyalty App at the time of purchase.
- (b) Points earned by you will be added to your account after a transaction has been completed.
- (c) Points may only be earned on products outlined in the Points Schedule. Points may not be earned on redemption transactions.
7. Redeeming points
- (a) Once you have registered and activated your Burger Wisconsin Loyalty App online and achieved a minimum Points balance of 50 (50c) you will be eligible to redeem those Points by presenting your Burger Wisconsin Loyalty App at a participating Burger Wisconsin store, to have the app’s barcode scanned.
- (b) When redemption takes place it will take place in respect of all the Points held to the credit of the app. There is no ability to partially redeem Points.
- (c) Points may only be redeemed on products outlined in the Points Schedule from participating Burger Wisconsin stores.
- (d) You must always have a minimum of 10 points on your Burger Wisconsin Loyalty App in order to redeem points.
- (e) A maximum limit of 300 points or $30 credit can be redeemed per customer, per transaction.
Point Balances (a) The balance of points held to the credit of your Burger Wisconsin Loyalty App can be checked at any time in a participating Burger Wisconsin store or by logging onto your app.
Expiry of Points (a) Points expire 12 months after the date on which the points were earned.
10. Liability
We are not liable for:
- (a) A delay in supplying replacement login information for your Burger Wisconsin Loyalty App;
- (b) Unauthorised use of your Burger Wisconsin Loyalty App;
- (c) Failure by you to notify a participating store that a purchase is a Burger Wisconsin Loyalty App transaction;
- (d) Failure to notify you of any changes to these terms and conditions;
- (e) Any error, misstatement or omission in the information and content contained on the Website;
- (f) Claim arising from or relating to termination of the Burger Wisconsin B. Dub Club Card program.
11. Termination
- (a) We reserve the right to suspend or terminate the Burger Wisconsin Loyalty App account at any time, in our sole discretion without prior notice.
- (b) In addition to our right to terminate or suspend the Burger Wisconsin Loyalty App account at any time, we may terminate your Burger Wisconsin Loyalty App account at any time without prior notice should:
- (i) You fail to comply with these terms and conditions; or
- (ii) Your Burger Wisconsin Loyalty App account is not used for a period of 6 months;
- (i) You fail to comply with these terms and conditions; or
- (c) Upon termination of your Burger Wisconsin Loyalty App account you will not be able to redeem any Points which might otherwise have been available to you.
